What the Batas Kasambahay says
Republic Act 10361, the Domestic Workers Act:
- Pay at least once a month, in cash, to the worker directly (Sec. 25).
- No deductions except those required by law, unless the worker agrees in writing (Sec. 25). Deposits for breakage aren’t allowed (Sec. 14).
- A payslip showing deductions, kept for three years (Sec. 26).
- Rest: 8 hours a day and 24 hours in a row each week (Sec. 20 and 21).
- 13th month pay (Sec. 25) and, after a year, 5 days’ paid leave a year (Sec. 29).
- SSS, PhilHealth and Pag-IBIG after a month of service, paid by the employer; from ₱5,000 a month, the worker pays a share (Sec. 30).
Questions
Before payday.
Why does the day’s rate change?
Because it comes from the work days in that pay period. The 1st to 15th might have 13 work days and the 16th to 31st only 12, so the same half-month pay gives a slightly different day’s rate. It keeps every payday fair to the days actually in it.
Can I take a cash advance off their pay?
Only with their written agreement. RA 10361 allows no deductions other than those required by law unless the worker agrees in writing, and it doesn’t allow deposits for breakage. Write down the amount and how many paydays it’s spread over, and both sign.
What’s the minimum wage for a kasambahay?
In Metro Manila, ₱7,800 a month from 7 February 2026, under Wage Order NCR-DW-06. Each region sets its own: check your Regional Wage Board’s latest order on the DOLE NWPC site.
Do I pay SSS, PhilHealth and Pag-IBIG?
Yes, once they’ve worked for you a month. The employer pays the premiums; when the kasambahay earns ₱5,000 or more a month, they pay their proportionate share (RA 10361, Sec. 30). Check each agency for the current rates.
How do I work out the 13th month pay?
The law gives kasambahay 13th month pay (RA 10361, Sec. 25). The usual rule is one-twelfth of the basic pay earned in the year: for a full year at ₱7,800 a month, ₱7,800.
Does this work for a driver or an assistant?
The maths does: pay, work days, absences and advances work the same way. Their wage rules may differ from a kasambahay’s, so check what applies to them.
